General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern all services and transactions carried out through our website www.studio.hanko.lu, including photography, video, and web design services, as well as the purchase of fine art prints from our online store.

By confirming a booking or placing an order, you agree to be bound by the following terms.

2. Services

(Photography, Video, and Web Design)

2.1 Booking & Payment Terms

All services require either a signed agreement (such as a signed price quote) or a written confirmation by email (info@hanko.lu).
To confirm your booking, an advance payment of 20% to 50%—or full payment, depending on the scope and nature of the project—may be required.
Final payment is due upon delivery and must be completed within 30 days. In the event of late payment, interest will be charged at a rate of 8 percentage points above the European Central Bank’s reference rate, calculated per annum, in accordance with EU Directive 2011/7/EU. A flat recovery fee of €40 will also apply to cover administrative costs.

2.2 Cancellation Policy

Cancellations must be made in writing by email.
If cancelled less than 48 hours before the scheduled service or production start: the advance payment is non-refundable.
If cancelled more than 48 hours in advance, alternative arrangements may be proposed depending on availability.

2.3 Delivery of Services

Photography and video deliverables will be provided via download links or private online galleries.
Web design projects will be delivered as published websites or ZIP files, depending on the agreement.
Delivery timelines are specified in each project’s proposal or contract.

2.5 Revisions

Each project includes up to three rounds of revisions unless otherwise specified in the agreement. Additional revisions may incur extra charges.

2.6 Data Retention

Final deliverables, as outlined in the signed price offer or proposal, will be made available for download for a period of 90 days following delivery.
Clients are responsible for downloading and backing up these files, as we do not guarantee long-term storage.
Source files (e.g., project files, RAW photos or video footage) will be archived for a maximum of 12 months. These source files can be provided to the client upon request, and may be subject to additional fees.

2.7 Use in Portfolio and Social Media

HANKO SÀRL reserves the right to use completed client projects (including images, video excerpts, and web design work) for promotional purposes on its websites, and social media channels. This usage does not include sensitive or confidential material unless expressly authorized by the client.
If a client does not wish for their project to be featured, they must notify us in writing via email prior to the delivery of the final work.

3. Fine Art Print Store

3.1 Product Information

Each print is an original photograph by Sérgio Alves Santos, professionally produced using premium fine art paper or other high-quality materials. Full product specifications are available on the respective product pages.

3.2 Prices and Payment

All prices are shown in euros (€), VAT included where applicable.
We accept major credit/debit cards and other payment methods listed on the checkout page.
If you choose to pay by wire transfer, please note that your order will only be processed once the payment has been received. If we do not receive the funds within 30 days, your order will be automatically cancelled.

3.3 Shipping & Delivery

Orders are processed and delivered within 12–18 working days (for deliveries within Luxembourg).
Delivery is free within Luxembourg. For other EU countries, shipping fees are calculated during checkout and included in the final price.

3.4 Refunds & Returns

If your print arrives damaged, please contact us within 7 days of receipt with photographic proof to request a refund or exchange.
If you are not satisfied with your order, you may request a refund. Return shipping may apply, and the item must be returned in its original condition.

4. Digital File Purchase & Licensing

4.1 Product Information

High-resolution digital versions of selected fine art photographs are available for purchase on our Fine Art Print Store.

File format: JPG
Recommended use: Suitable for websites, digital presentations, screen wallpapers, and small-scale prints
Delivery: Files are delivered immediately after purchase via a secure download link

4.2 License and Usage Rights

Each digital file comes with a commercial use license, allowing you to use the image for:

Websites and blogs
Social media content and digital marketing
Online advertisements
Printed materials used to promote your business (e.g., brochures, flyers)

4.3 Prohibited Uses

The following uses are strictly prohibited:

Reselling the image in any format (digital or physical), including but not limited to posters, prints, merchandise, stock libraries, or templates
Sharing or distributing the file to any third party, whether free of charge or for profit

Violations of these terms may result in legal action.

If you require an extended license—for use in merchandise, mass production, or resale—please contact us directly to discuss custom licensing.

5. Intellectual Property

All photographs, texts, visuals, designs, and materials on this website are the exclusive property of HANKO SÀRL and may not be used or reproduced without prior written consent.

6. Limitation of Liability

HANKO SÀRL shall not be held liable for any indirect or consequential damages resulting from the use of our services or products. Our liability is limited to the total amount paid for the corresponding order or project.

7. Force Majeure

HANKO SÀRL shall not be held liable for delays or failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, strikes, government restrictions, or failure of third-party suppliers.

8. Privacy and Data Protection

Personal data collected during purchases or bookings is processed in accordance with our Privacy Policy. We are committed to protecting your privacy and do not share your data with third parties, except where required to fulfill your order or by law.

9. Governing Law and Jurisdiction

These terms are governed by the laws of Luxembourg. Any disputes will be subject to the exclusive jurisdiction of the courts of Diekirch, Luxembourg.
